No Win No Fee Solicitors
In order to minimise the risk on your behalf, we only work with solicitors who offer impeccable levels of service in their specialist field of expertise and who also offer their services on a No Win No Fee basis. What this means is that if your case gets taken on and the solicitors for some reason do not win your case, then you do not have to pay a penny to them, it’s as simple as that.
Conditional Fee Agreement (CFA)
What this means is that when a solicitor takes on your case and wins, there is a “success fee” to be paid to the successful solicitor for managing to get you the maximum amount of compensation. This is standard procedure with most No Win No Fee solicitors.
You may already have cover for legal expenses and may need to check your paperwork to verify this. The most typical legal cover comes when you buy car insurance. If using a comparison website, there is usually a section that is titled: “Legal Protection” or something similar. This means that you get legal cover for up to a certain amount. You will need to check the terms and conditions to make sure you are covered.
In this case, you may get a phone call from your insurer in order to arrange your legal representation, however you are free to choose whoever you like, which means you do not have to go with the insurer’s recommended representation. You can contact your insurer and we can arrange for them to cover you with one of our solicitors.
Usually when you have won your compensation claim, you can also claim some/all costs from the opposite side. These are usually called disbursements and include things like for example, if our solicitor needs to obtain your medical notes from your doctor or from the hospital, they may charge us for this. This kind of cost can be claimed back from the other side if your claim for compensation is successful. If however you lose, your legal expenses insurer should cover these costs.
The success fee is something that cannot be claimed from the other side. You have to pay our solicitors for winning the case for you (there is no success fee if our solicitors lose your case). This is however capped at a maximum of 25% of the damages awarded for pain, suffering, loss of amenity and damages for pecuniary loss (monetary). This is to make sure that the solicitors do not take advantage of a large monetary sum that you may have won.
